It is based on the story of five friends who kidnapped drug dealer Ben Markowitz’s little brother in August 2000 to pay off their debts. At first Nicholas panicked, but the group of friends gave him drugs and alcohol. They drove him to Santa Barbara, took him to parties and even promised him he would be fired.

He was arrested in 2005 and is serving life without parole at Richard J. Donovan Correctional Facility in San Diego, California.
He was sentenced to life imprisonment with the possibility of parole after seven years. His application for parole was denied in 2006. On July 2, 2013, Rugge was granted parole and on October 24, 2013 he was released from prison after serving 11 years of his life sentence.

On August 6, 2000, 15-year-old Nick Markowitz snuck out of his home to avoid a fight with his parents. Nick happened to be walking down the street in West Hills, CA when local drug dealer Jesse James Hollywood and two of his associates, Jesse Rugge and William Skidmore, saw him.
As in the Alpha Dog film, the real Frankie Ballenbacher, Jesse Rugge (left, ca. 2013), helped kidnap Nicholas Markowitz and was present at the murder. Actor Justin Timberlake (right) portrays Rugge in the film.
As of 2020, James resides in Austin, Texas, operates Jesse James Fire Arms Unlimited and manages the intellectual property of West Coast Choppers.
